Trade Terms and Conditions

None of the below affects your statutory rights

Please take the time to read through the below, they are for the benefit of both us ‘ the wholesaler’ and you ‘ the client’. When you trade with us it is deemed you have accepted them. If any aspect of the below remains unclear to you please contact us.

General
 i) Placing an order by whatever means, email, website, fax, verbal will constitute acceptance of these terms and conditions and the transaction will be governed by them. The contract between the Client and the wholesaler will be deemed to become legally binding when the ordered furniture is paid for in full or part by the Client and the funds have cleared in our bank account.
ii) We the wholesaler retain the right to change our terms and conditions from time to time and without notice. Any changes placed to our terms and conditions will be updated on this website and will become effective immediately. We suggest you check them regularly; however we will notify you by email when changes are made.
iii) The wholesaler reserves the right to reject any application for an account which they feel is not a genuine trade application. The Wholesaler also reserves the right to request additional information to that included within the Client’s application for an account. This may include recent trade invoices/company letterheads from the applicant.
iv) The wholesaler reserves the right to cancel any order at any time should we deem fit for whatsoever reason. We can inform the client by whatever means ie. email, text, fax telephone. It is the client’s responsibility to ensure we have all address’s/ point of contact details in order that they can be contacted. A refund will be given if applicable.
v) The wholesaler will not be held liable for any damage or loss caused by the Wholesaler’s delivery company or any of our third party couriers when inside the Client’s property. The Wholesaler’s delivery company and any third party courier used by the Wholesaler is contracted to deliver to the clients door. Should the client request assistance into the client’s property it is at the client’s own risk.
vi) The wholesaler and our chosen delivery partners will only carry out deliveries whereby a client is present to accept and sign for the goods unless otherwise requested by the client. Should the client request items be left without signature, inside or outside the client’s property, The Wholesaler will not be held liable for any loss or damage to the goods incurred as a result. Whereby the client requests items be delivered in such a manner, the goods will become the ownership and responsibility of the Client at the point which the item is delivered to the client’s address.
vii) Goods collected from us; once on the clients transport or third parties transport they are wholly the responsibility of the client.
viii) We will not be held liable for any delay in order, disruption or cancellation due to a result of an Act of God, war, strike, labour dispute, fire, floor, drought, or other causes beyond our reasonable control.

Returns & Refunds:

All faults should be notified to us with 5 working days and be supported with; clear photographs that show the damage, clear photographs of the packaging (to demonstrate condition of packaging), details of product batch number, QC number, which is normally a sticker discreetly placed on the back/underside.

Any claim of defect after 30 days of delivery will not be accepted. Any incomplete claims whereby all of the above details are not sent in writing, by email to admin@martagonimports.co.uk will be rejected.
We will under no circumstances replace or refund any products after 30 days from the delivery date. We do not replace non faulty goods.

 We will endeavour to replace all faulty/defective goods asap, delays may occasionally occur whilst we wait for goods to arrive from our suppliers. (We will replace such goods at our own transport costs). If we are no longer able to source the goods then a full refund or credit note will be offered, the client can choose either. All returned goods must be returned to us in a saleable condition, in the original packaging. In order to facilitate this we ask that the goods are un-wrapped carefully to protect the packaging. Under no circumstances will any credit notes/refunds be issued prior to the goods being returned to or collected by the Wholesaler. We reserve the right to decide whether we offer a replacement or repair to the Client.

Product Characteristics

i. Our furniture products are made from natural wood and wood veneers, accordingly appearances may vary. Some woods, particularly Oak, can mellow in colour with age and exposure to sunlight. You are buying handmade furniture where varying degrees of distressing may apply from piece to piece; this may involve wood splits, wood filling, knots, purpose distress/scratch marks, antiquing etc.
ii. We endeavour to display as accurately as possible the true colours of our products in the marketing material provided and via the website, however we cannot guarantee the accuracy of the photographs. We will not accept colour and shade discrepancies as a reason for defect.
iii. All dimensions specified by us are approximate and are used as a guideline. We cannot guarantee the complete accuracy of the dimensions that are shown on our website/promotion materials and will not accept dimensions as a reason for a return.

Payment

All goods must be paid for in full prior to delivery/collection from our warehouse unless otherwise agreed by us. We accept bacs, credit/debit cards.

Pallet Orders qualifying for FREE Delivery

The minimum free delivery FOR PALLETS orders value is now £900 ex vat
There is a £45 surcharge for triple robes delivered by pallet also.
